Acceptance of Terms

By downloading, accessing, or using the Sorbio Kids mobile application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use our App.

Who Can Accept These Terms

  • You must be at least 18 years old to create an account
  • You must be a parent or legal guardian of the child who will use the App
  • You are responsible for your child's use of the App and compliance with these Terms

Agreement on Behalf of Your Child

By creating an account, you represent that:

  • You have legal authority to agree to these Terms on behalf of your child
  • You will supervise your child's use of the App
  • You understand and consent to the collection of your child's information as described in our Privacy Policy

Service Description

What Sorbio Kids Provides

Sorbio Kids is an educational audio storytelling platform designed for children ages 5-8. Our service includes:

  • Original Audio Stories: Age-appropriate educational content focusing on child development
  • Development Tracking: Progress monitoring across four key areas: Emotional Intelligence, Focus & Calm, Resilient Thinking, and Expression & Connection
  • Personalized Recommendations: Story suggestions based on your child's age, interests, and development goals
  • Parent Dashboard: Tools for parents to monitor progress and engage with their child's learning

Service Availability

  • Service Model: Free trial with subscription-based premium content
  • Geographic Availability: Australia and Singapore
  • Platform: iOS mobile application via Apple App Store
  • Free Content: First 2 episodes of every story series
  • Premium Content: Full story series access and Parent Hub development tracking features

User Accounts and Responsibilities

Account Creation

  • Parental Account: Only parents/guardians (18+) may create accounts
  • Child Profile: You may create one profile per child within your account
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials

Your Responsibilities

  • Accurate Information: Provide accurate and current information during registration
  • Appropriate Use: Ensure your child uses the App appropriately and safely
  • Supervision: Monitor your child's use of the App and content consumption
  • Account Security: Keep your login credentials secure and notify us of unauthorized access
  • Compliance: Ensure use complies with these Terms and applicable laws

Child Safety

  • Parental Supervision: The App is designed for use with parental guidance
  • Content Appropriateness: While our content is age-appropriate, parental discretion is advised
  • Device Security: Secure your device and prevent unauthorized access by other children

Payment Terms and Subscription

Free Trial Period

  • Trial Duration: 7 days from account creation
  • Trial Access: Full access to all content and features, including:
    • All audio stories (episodes 1, 2, 3+)
    • Parent Hub development tracking features
    • Progress monitoring and personalized recommendations

Trial Requirements:

  • Valid payment method required at signup (processed via Apple App Store)
  • No charges during the 7-day trial period
  • You may cancel anytime during the trial without charge
  • If not cancelled, subscription begins automatically after trial ends

Subscription Pricing

  • Australia: AUD $7.99 per month
  • Singapore: SGD $7.99 per month
  • Billing: All payments are processed through the Apple App Store

Free vs. Premium Content

Always Free:

  • First 2 episodes of every story series
  • Basic app functionality
  • Account creation and profile management

Premium Subscription Required:

  • Episodes 3 and beyond for all story series
  • Parent Hub development tracking features
  • Progress reports and detailed development insights
  • Personalized learning recommendations

Cancellation Policy

How to Cancel:

  • Through your Apple App Store account settings (Settings > [Your Name] > Subscriptions)
  • Contact Apple customer support directly
  • Email us at support@sorbiokids.com (we will guide you through Apple's cancellation process)

Cancellation Timing:

  • Cancel anytime before trial ends: No charge
  • Cancel during active subscription: Access continues until current billing period ends
  • No partial refunds for unused time within billing period

Refund Policy

Apple App Store Refunds: All refund requests are handled by Apple according to their App Store refund policy.

How to Request Refunds:

  • Visit reportaproblem.apple.com
  • Select the relevant purchase and request a refund
  • Contact Apple Support directly

Intellectual Property Rights

Sorbio's Intellectual Property

Comprehensive Ownership: All content, including but not limited to:

  • Audio stories, scripts, and narrative content
  • Character names, voices, and personalities (including Piku the Penguin and Bobo the Elephant)
  • Educational frameworks and development methodologies
  • App software, user interface, and design elements
  • Logos, trademarks, and brand elements
  • Progress tracking algorithms and personalization technology

License to You

Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use the App for your child's personal, non-commercial use
  • Stream audio content within the App on authorized devices
  • Use progress tracking and educational features for your family

License Restrictions:

  • License is limited to your immediate household
  • No right to download, copy, or distribute content outside the App
  • No right to modify, adapt, or create derivative works
  • License terminates upon account termination or breach of Terms

Limitation of Liability

Disclaimer of Warranties

"AS IS" BASIS: The Sorbio Kids App is provided "as is" and "as available" without warranties of any kind, either express or implied.

NO WARRANTIES: We disclaim all warranties, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Non-infringement of third-party rights
  • Uninterrupted or error-free operation
  • Accuracy or completeness of content
  • Specific educational outcomes or developmental results

Maximum Liability

Our total liability to you is limited to the greater of:

  • One Hundred Australian Dollars (AUD $100), or
  • The total amount you paid us in the 12 months preceding the claim

Consumer Protection Laws

Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies consumer guarantees under Australian Consumer Law or any other rights that cannot be excluded under Australian law.

Singapore Users: Nothing in these Terms excludes statutory consumer protection rights under Singapore law.

Privacy and Data Protection

Privacy Policy Integration: Our Privacy Policy (available at www.sorbiokids.com/privacy) is incorporated into these Terms.

  • Data Collection: We collect and use information as described in our Privacy Policy
  • Child Privacy: We are committed to protecting your child's privacy and comply with applicable privacy laws
  • Your Consent: By using our service, you consent to data processing as described in our Privacy Policy

Termination

Termination by You

Right to Terminate: You may terminate your account at any time.

How to Terminate:

  • Request account deletion through app settings (when available)
  • Your account and child's data will be deleted within 30 days
  • Remember to cancel your subscription separately through Apple App Store

Termination by Us

Grounds for Termination: We may terminate your account for:

  • Violation of these Terms
  • Fraudulent or deceptive activity
  • Misuse of our intellectual property
  • Harmful or illegal activity
  • Extended inactivity (24 months with notice)

Governing Law and Dispute Resolution

Governing Law

Primary Jurisdiction: These Terms are governed by the laws of Singapore.

Consumer Protection: Australian and Singapore consumer protection laws apply to users in those countries where applicable. In case of conflict, the higher standard of protection applies.

Dispute Resolution Process

  • Step 1 - Informal Resolution: Contact us at support@sorbiokids.com to resolve disputes informally
  • Step 2 - Formal Notice: If informal resolution fails, provide written notice including nature of dispute, desired resolution, and supporting documentation
  • Step 3 - Mediation: We may engage in mediation through a mutually agreed mediator
  • Step 4 - Arbitration/Court: Disputes will be resolved through Singapore International Arbitration Centre (SIAC) or appropriate local courts

General Provisions

Updates to Terms

  • Notification: We will notify you of material changes via email or in-app notification
  • Effective Date: Changes become effective 30 days after notification unless you terminate your account
  • Continued Use: Continued use after changes constitutes acceptance

Additional Terms: Your use of the App is also governed by Apple's App Store Terms of Service.

Apple as Third-Party Beneficiary

Apple is not responsible for:

  • The App or its content
  • Maintenance or support services
  • Product liability claims
  • Intellectual property infringement claims

Our Responsibility: We are solely responsible for:

  • App content and functionality
  • Customer support and maintenance
  • Legal compliance and liability claims
